PRIVACY POLICY

This Privacy Policy applies only to the website (the “Site”) controlled by Bridgelux, Inc. (“Bridgelux,” “we,” or “us”). Please read the Privacy Policy carefully. BY USING THE SITE, YOU ACKNOWLEDGE YOU HAVE READ AND UNDERSTOOD THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE SITE.

A. INFORMATION COLLECTED

We collect two types of information from visitors to the Site: (1) Personally identifiable information; and (2) Non-personally identifiable information.

(1) Personally Identifiable Information

"Personally identifiable information" is any information relating to an identified or identifiable natural person. Bridgelux collects and stores the personally identifiable information that you have provided to us. We collect the following personally identifiable information on the Site:

  • We collect your e-mail address and any other personally identifiable information that you provide to us in an e-mail if you contact us with a question;
  • We collect your name, address, phone number, e-mail address, and any other personally identifiable information that you provide to us if you contact us to apply for employment;
  • We collect your name, address, phone number, e-mail address, company name, and any other personally identifiable information that you provide to us through your registration on or use of the Site or if you otherwise contact us regarding product information, sales inquiries, supplier inquiries, distributor inquiries, or customer support / service inquiries;
  • We collect your name, address, phone number, e-mail address, company name, and any other personally identifiable information that you provide to us by completing a registration questionnaire or providing your business card to us at a trade show or other conference or meeting. 

If you do not want Bridgelux to collect your personally identifiable information, please do not provide it to us.

(2) Non-Personally Identifiable Information

“Non-personally identifiable information” can be technical information or it can be demographic information, such as your age or gender. Non-personally identifiable information does NOT identify you personally. Please note that, over time, non-personally identifiable information could become personally identifiable information through regulatory developments, technological advancements, or co-mingling with personally identifiable information.

B. COOKIES AND SIMILAR TECHNOLOGIES

Cookies are small text files sent by a web server to your web browser and saved locally on your computer or device. The cookie allows the server to uniquely identify the browser on each page. Cookies do not cause any harm to your computer and do not contain viruses. We use, and allow certain third parties to use, cookies and other similar technologies to provide our services and to help collect data. We, or third parties, may use session cookies or persistent cookies. Session cookies only last for the specific duration of your visit and are deleted when you close your browser. Persistent cookies remain on your device’s hard drive until you delete them or they expire. Different cookies are used to perform different functions, which we explain below:

  • Essential. Some cookies are essential in order to enable you to move around our Site and use their features, such as accessing secure areas of the Site. Without these cookies, we cannot enable appropriate content based on the type of device you are using.
  • Browsing and functionality. These cookies allow us to remember choices you make on the Site, such as your preferred language, and provide enhanced, more personalized features.
  • Performance and analytics. We use our own cookies and third party cookies to see how you use our Site in order to enhance their performance and develop them according to your preferences. PLEASE NOTE THAT THIS POLICY DOES NOT COVER THE COLLECTION AND USE OF INFORMATION BY SUCH THIRD PARTY WEBSITES AND ADVERTISING COMPANIES.
    • Google Analytics. Google Analytics uses cookies to report on user interactions on our and others’ websites. We use the data collected for optimizing marketing, refining advertising and/or programming strategies and generally making advertising more effective, etc. You can opt-out of the Google Analytics Advertising Features we use by indicating your preference using the interest-based opt-out link here. Google also provides a complete privacy policy and instructions on opting-out of Google Analytics here. Note that Google’s opt-out mechanism is specific to Google activities and does not affect the activities of other ad networks or analytics providers that we may use.
    • MailChimp.  We use MailChimp, a marketing platform and email marketing tool for small businesses.  We use the data collected for customizing our marketing efforts, etc.

There are several ways to manage cookies. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The Help feature on most browsers provide information on how to accept cookies, disable cookies or to notify you when receiving a new cookie. Please note, however, that by blocking or deleting cookies which are “strictly necessary,” you will not be able to access certain features of our Site.

In the US, the Network Advertising Initiative also offers a means to opt-out of a number of advertising cookies. Please visit www.networkadvertising.org to learn more. Note that opting-out does not mean you will no longer receive online advertising. It does mean that the company or companies from which you opted-out will no longer deliver ads tailored to your preferences and usage patterns.

C. USE OF INFORMATION COLLECTED VIA THE SITE

(1) Personally Identifiable Information

We use your personally identifiable information that is collected on this Site or by other means primarily for the following purposes:

  1. To deliver information, products or services you request or purchase;
  2. To complete a transaction or service requested by you;
  3. To notify you about a material change to this Privacy Policy, if necessary;
  4. To contact you in response to general e-mail inquiries and specific inquiries regarding employment, sales, suppliers, distributors, and support and service requests;
  5. To contact you in response to your registration on the Site for future communications, specific inquiries and/or for downloading information;
  6. To ensure the Site is relevant to your needs; and
  7. To help us create and publish content most relevant to you.

(2) Non-Personally Identifiable Information

Non-personally identifiable information is used as described above and in other ways as permitted by applicable laws, including combining non-personally identifiable information with personally identifiable information. When non-personally identifiable information is combined with personally identifiable information, we treat the resulting information as personally identifiable information.

D. LEGAL BASES FOR PROCESSING

We base the above mentioned processing activities of your personally identifiable information on the following legal bases:

  • Processing for letters a) through e) is necessary to establish and fulfill a contract with you (Art. 6 para. 1 sentence 1 b) GDPR).
  • Processing for letters f) and g) is based on your consent (Art. 6 para. 1 sentence 1 a) GDPR).

E. SHARING AND DISCLOSURE OF INFORMATION

(1) Personally Identifiable Information

We may share or disclose your personally identifiable information in the following instances:

  • To sales representatives, suppliers, and distributors. For example, if you e-mail us with a question regarding our services or the purchase of our products, or related to the supply or distribution of our products, we may use your information to process your request and share your information with our sales representatives, suppliers or distributors so that they can contact you directly;
  • To affiliates, strategic partners, agents, third party marketers or other unaffiliated parties who are offering products or services that we believe may be of interest to you or who require your personally identifiable information for research, administrative and/or internal business purposes. These parties may use your personally identifiable information to contact you with an offer or advertisement related to a product or service, or they may use such information for their own research, administration or business purposes. If you no longer wish us to share this information please inform us through our opt-out procedure.
  • To unaffiliated third-party service providers, agents or independent contractors who help us maintain our Site and provide other administrative services to us (order processing and fulfillment, providing customer service, maintaining and analyzing data, and sending customer communications on Bridgelux’s behalf). We seek to ensure that these unaffiliated third parties will not use the personally identifiable information for any other purpose than to provide the administrative services for which they are responsible. Because such unaffiliated third-party service providers that help us administer our Site will have access to users’ personally identifiable information, if you do not wish for our unaffiliated third-party service providers to have access to your information, please do not submit any personally identifiable information to us;
  • To comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, including the rights and property of Bridgelux or act in urgent circumstances to protect the personal safety of our end users;
  • To third parties as part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets; and
  • To track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties. Please see the Cookies section above for more information.

Except as described in this Privacy Policy or at the time we request the information, we do not otherwise use, share or otherwise disclose your personally identifiable information to any third parties.

(2) Non-Personally Identifiable Information

We use non-personally identifiable information collected on the Sites in the manner disclosed above, in Section C. We may share this non-personal information with third parties.

F. COLLECTION AND USE OF INFORMATION FROM CHILDREN

The Site is not directed to children under the age of 13, or 16 in the European Union (“EU”), and we do not knowingly collect personal information from children under the age of 13, or 16 in the EU, on the Site. If we become aware that we have inadvertently received personal information from a visitor under the age of 13, or 16 in the EU, on the Site, we will delete the information from our records.

G. THIRD PARTY WEB SITES

This Privacy Policy applies solely to information collected on the Site. The Site may contain links to other web sites. We are not responsible for the privacy practices or the content of these other web sites.

H. INTERNATIONAL TRANSFER OF INFORMATION

If you choose to provide us with personally identifiable information, Bridgelux may transfer that information to its affiliates and subsidiaries or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personally identifiable information to the United States, or other jurisdictions, which may not have the same data protection laws as the EU and other regions. With knowledge of these risks, by providing your personally identifiable information you understand:

  • Your personally identifiable information will be used for the uses identified above in accordance with this Privacy Policy; and
  • Your personally identifiable information will be transferred to the United States as indicated above.

I. YOUR RIGHTS AND CHOICES

Please contact us at the address below if you have questions about your personally identifiable information or if you would like to otherwise make a change to such information.

Additionally, residents of the EU have the right to:

  • Obtain confirmation as to whether or not your personally identifiable information exists and to be informed of its content and source, verify its accuracy and request its completion, update, or amendment;
  • Request the deletion, anonymization or restriction of the processing of your personally identifiable information processed in breach of the applicable law;
  • Object to the processing, in all cases, of your personally identifiable information for legitimate reasons;
  • Receive an electronic copy of your personally identifiable information, if you would like such a copy for yourself or to port your personally identifiable information to a different provider;
  • Lodge a complaint with the relevant data protection supervisory authority.

J. SOCIAL MEDIA BUTTONS

On our Site we use the following social media plug-ins: Facebook, LinkedIn, Twitter, YouTube. The plug-ins can be identified by the social media buttons marked with the logo of the provider of the respective social media networks.

We have implemented these plug-ins using the so-called 2-click solution. This means that when you surf on our Site, personally identifiable information will initially not be collected by the providers of these social media plug-ins. Only if you click on one of the plug-ins will your personally identifiable information be transmitted: By activating the plug-in, data is automatically transmitted to the respective plug-in provider and stored by them (in the case of US providers your personally identifiable information will be stored in the USA). We neither have influence on the collected data and data processing operations conducted by the providers, nor are we aware of the full extent of data collection, the purposes or the retention periods.

K. ASSIGNMENT

In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personally identifiable and non-personally identifiable information collected via the Site.

L. CHANGES TO THIS PRIVACY POLICY

We reserve the right to change this Privacy Policy from time to time. When we do, we will also revise the “Last Updated” date at the top of this Privacy Policy. When we make material changes to this Privacy Policy, we will send a notice to your e-mail address, if one is on file, and will place a prominent notice on the Site.

M. SECURITY AND RETENTION

No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you submit to the Site is done at your own risk.

Once we receive your transmission, we make reasonable efforts to ensure security on the systems. We have protocols in place to protect your information from unauthorized access, disclosure, alteration, or destruction. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software.

In accordance with the General Data Protection Regulation (GDPR), starting on May 25, 2018 we will report security systems data breaches within 72 hours of discovery.

By using this Site or providing personally identifiable information to us you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of this Site. We may post a notice on the Site if a security breach occurs. We may also send an e-mail to you at the e-mail address you have provided to us in these circumstances.  Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

We will keep your personally identifiable information for as long as necessary to perform the purposes set out in this Privacy Policy. Laws may require us to hold certain information for specific periods.

 

N. YOUR CALIFORNIA PRIVACY RIGHTS

Beginning on January 1, 2005, California Civil Code Section 1798.83 permits our visitors who are California residents to request certain information regarding Bridgelux's disclosure of personally identifiable information to third parties for their direct marketing purposes.
